Here are some frequently asked questions that will help you better understand EPL Defense Shield, our new solution for employers with 25 or fewer employees.

What is EPL Defense Shield?
EPL Defense Shield is an insurance policy that provides coverage for the costs to defend an employment practices liability (EPL) lawsuit, which typically contain allegations such as harassment, wrongful termination, or discrimination.

Why Do Small Companies Need EPL Expense Coverage?
Every aspect of the employment relationship can give rise to an employment claim – from interviewing to post-termination referrals. Being a small company doesn’t offer immunity from these claims.

What is a “Defense Cost Only” Policy?
A “defense cost only” policy is specifically meant for the small business that has forgone the purchase of a more expensive, traditional EPL product. EPL Defense Shield offers cost-efficient protection against the only known expense present in all lawsuits, regardless of merit: attorneys’ fees to defend a claim.

My clients strictly follow their Human Resources policies. Why should they consider this coverage?
Companies can be sued for employment practices claims, even if they did nothing wrong. The sad fact is that more than 60 percent of all charges filed with the EEOC in 2006 were found to have “No Reasonable Cause,” but the claims still have to be defended. The costs to defend even groundless claims can be devastating – even if the company wins.

Who is covered under an EPL Defense Shield policy?
In addition to the corporate entity, insureds include any past, present, or future directors, officers, trustees, or governors and employees.

What is considered a “Wrongful Employment Act” under an EPL Defense Shield policy?
Generally, any actual or alleged wrongful termination (including an act of retaliation), wrongful failure to employ or promote, negligent supervision of hiring, harassment, and various forms of discrimination are considered a wrongful employment act under an EPL Defense Shield policy.

My client is an employer with only 12 employees. Since Title VII does not apply to their company, why should they buy an EPL Defense Shield policy?
There are still many state laws that govern the requirements of employers with fewer than 15 employees. In addition, there are cases that have resulted in such smaller companies unknowingly becoming exposed to Title VII liability (Arbaugh v. Y & H Corp., dba The Moonlight Café, 546 U.S. 500 (2006).

My client is considering buying an EPL Defense Shield policy. Where do I get an application?

What does it mean when coverage is written on a surplus lines basis only?
Generally speaking, the policy comes from a surplus lines carrier as opposed to an admitted carrier in a particular state. Certain state-enforced protections found on admitted policies are generally not applicable to policies written by surplus lines carriers. In addition, the insured must pay a surplus lines tax on the policy.

How much does the policy cost? What is the limit of liability and retention?
An insured’s premium amount will depend upon exactly how many employees it has and which coverage level it selects. The chart attached shows premium amounts for the various coverage levels available.
